New Legislation Signed Into Law
I would like to share with you a bill that was signed into law by Governor DeSantis during the 2019 legislative session in regards to Private Property Rights.
HB 1159 prohibits a local government from requiring a notice, application, approval, permit, fee or mitigation for pruning, trimming or removal of a tree on residential property when an arborist or landscape architect documents that the tree presents a danger to persons or property.
Prior to this legislation, the City of Mount Dora required a permit for removal of a tree on personal property (Sec 90.150). CS/HB 1159 will now allow you to have a tree pruned or removed without a permit, so long as an arborist or landscape architect deems the tree to be a danger to persons or property.
I share this with you because bills like HB 1159 chip away at Home Rule. Home Rule allows local government to govern towns, cities and municipalities through Codes and Ordinances created by local officials.
